Renewing a Czech residence permit: the 120-day window and the wait
Count 120 days back from the expiry date. Miss the last day and your stay stops being lawful. How the window works, and what to do while you wait.

The most useful date in a foreigner's Czech calendar is not on the card as a big number. It is the number 120, counted backwards from the expiry date. That is the earliest day on which an extension application can be filed, and missing the other end of the window, the expiry date itself, is the one error that is hard to repair.
The Foreigners Act (Act No. 326/1999 Coll.) and the Ministry's practice change, so check the current instructions for your permit type.
The window
Under the Foreigners Act, an application to extend a long-term residence permit is filed with the Ministry of the Interior, Department for Asylum and Migration Policy (OAMP), no earlier than 120 days before the current permit expires and no later than the day it expires (as of 2026; check the Ministry of the Interior). The same logic applies to different permit types, such as the employee card, the Blue Card, the study permit and family permits, though the documents differ; our explainer on employee cards and Blue Cards covers the work permits themselves.
Count carefully. A card that expires on 30 June 2027 (a hypothetical date) opens the filing window at the beginning of March 2027, and closes at the end of 30 June. Put the first day in your calendar, not just the last, because the Ministry's appointment system is easier to use at the start than in the final fortnight. If you hold more than one card, for example one for yourself and one for a child, each has its own expiry and its own window.
What a timely filing does
If you file within the window, your stay remains lawful while the Ministry decides, even if the card expires in the meantime. The Ministry gives you a confirmation that the application was received. It is not a new residence card, and it does not by itself say what you may do, so read it, keep it with your passport and ask what travel and employment it allows. Many holders find that employers, banks and landlords do not know how to treat it; a short explanation, with the Ministry's contact details, is better than an argument.
If you file late, the position is worse. The extension procedure is meant for holders who still have a valid permit. A permit that has expired is not extended, and a person who stays after expiry without a valid basis is in an unlawful position, which may lead to a fine and can complicate a later application. If you have missed the date for any reason, contact the Ministry at once and ask what remedies exist; do not wait for a letter. That is legal territory, and an immigration lawyer is the right adviser.
Documents to prepare
The Ministry publishes a list for each permit and purpose. The same themes recur: a valid passport, the application form, a photograph, evidence of accommodation, evidence that the purpose of stay continues and proof of health insurance. For a worker, that is usually a current employment contract or a confirmation from the employer, matched to the job on the card. For a student, it is confirmation of enrolment. For a family member, it is proof that the relationship and the sponsor's status continue. Our guide to the long-term residence permit describes the application for the first card, and much of the paperwork carries over.
A few documents tend to cause trouble at renewal. A passport that is about to expire may have to be renewed first, since the Ministry looks at its validity. An address that has changed since the last application should have been reported as it happened; our piece on registering your address explains the duty, and the Ministry compares the address you give with the one it has on file. Health insurance must be valid for the whole period: see how Czech health insurance works for foreigners. And a job that has changed without notification to the Ministry will surface at this stage; see how to switch employers on an employee card.
Documents issued abroad that you need again, such as a criminal-record certificate, may need to be recent and, if foreign, legalised and translated; see apostille and legalisation and sworn translations. Whether a fresh certificate is needed at extension depends on the permit; ask before you order one. Where documents are required, the Ministry generally wants them no older than 180 days (as of 2026; check MV).
The wait
Statutory decision periods exist, and in many cases the Ministry decides within them, but real waiting times vary by office, season and the completeness of the file. Do not plan a house move, a job change or a long trip on the assumption that the new card will arrive by a certain date.
Three practical points follow. First, travel: a holder who has filed for an extension and carries the confirmation can usually move within the country, but crossing borders is a different matter. The rules on re-entering the Schengen area or Czechia with an expired card and a confirmation are specific and have caused trouble for travellers. Ask the Ministry in writing before you book a trip, and keep the answer. Second, work: if your permit allows work, a timely application normally preserves that, but your employer will want to see the confirmation. Third, changes: tell the Ministry if your circumstances change during the wait, for example a new job, a new address or a change in family status. A change you do not report can lead to a refusal even if you were eligible when you applied.
When the card is ready, the Ministry tells you how to collect it. Check the details on it as soon as you have it: the name, the date of birth, the purpose and the validity. Mistakes are easier to fix at the counter than later. Then do the arithmetic again for the next renewal. If you are building towards permanent residence, keep a record of your absences from Czechia, since long periods abroad can break the continuity the application needs.
When it goes wrong
A refusal, a request to supplement the file or a decision that the permit should be cancelled each has deadlines of its own, usually short. The letter states them. A decision can usually be appealed within the period shown in it, and an appeal that is late is not heard. If you receive a request to supplement, answer it in full and on time, and keep proof of how and when you sent the documents. For anything that threatens your status, seek help from an immigration lawyer or an organisation that works with foreigners, and bring the full file, including the original card.
Frequently asked questions
How early can I apply to renew my Czech residence permit?
No earlier than 120 days before the permit expires, and no later than the day it expires (as of 2026; check the Ministry of the Interior).
Am I allowed to stay if my card expires while the Ministry is deciding?
If you filed in time, your stay remains lawful during the procedure. Keep the confirmation of filing with you.
Can I travel abroad while my renewal is pending?
It depends on your situation, and the rules are specific. Ask the Ministry in writing before you book.
What if I miss the deadline?
Contact the Ministry immediately and consider legal advice. A late filing is not an ordinary extension.
